Should artists be paid for training data? OpenAI VP wouldn’t say


Should artists whose work was used to train generative AI like ChatGPT be compensated for their contributions? Peter Deng, VP of consumer product at OpenAI — the maker of ChatGPT — was loath to give an answer when asked on SXSW’s main stage this afternoon.

“That’s a great question,” he said when SignalFire venture partner (and former TechCrunch writer) Josh Constine, who interviewed Deng in a wide-ranging fireside, asked the question. Some in the crowd of onlookers shouted “yes” in response, which Deng acknowledged. “I’m hearing from the audience that they do. I’m hearing from the audience they do.”

That Deng dodged the question isn’t surprising. OpenAI is in a delicate legal position where it concerns the ways in which it uses data to train generative AI systems like the art-creating tool DALL-E 3, which is incorporated into ChatGPT.

Systems like DALL-E 3 are trained on an enormous number of examples — artwork, illustrations, photos and so on — usually sourced from public sites and data sets around the web. OpenAI and other generative AI vendors argue that fair use, the legal doctrine that allows for the use of copyrighted works to make a secondary creation as long as it’s transformative, shields their practice of scraping public data and using it for training without compensating or even crediting artists.

OpenAI, in fact, recently argued that it would be impossible to create useful AI models absent copyrighted material. “Training AI models using publicly available internet materials is fair use, as supported by long-standing and widely accepted precedents,” writes the company in a January blog post. “We view this principle as fair to creators, necessary for innovators, and critical for U.S. competitiveness.”

Creators, unsurprisingly, disagree.

A class action lawsuit brought by artists including Grzegorz Rutkowski, known for his work on Dungeons & Dragons and Magic: The Gathering, against OpenAI several of its rivals, Midjourney and DeviantArt, is making its way through the courts. The defendants argue that tools like DALL-E 3 and Midjourney replicate artists’ styles without the artists’ explicit permission, allowing users to generate new works resembling the artists’ originals for which the artists receive no payment.

OpenAI has licensing agreements in place with some content providers, like Shutterstock, and allows webmasters to block its web crawler from scraping their site for training data. In addition, like some of its rivals, OpenAI lets artists “opt out” of and remove their work from the data sets that the company uses to train its image-generating models. (Some artists have described the opt-out tool, which requires submitting an individual copy of each image to be removed along with a description, as onerous, however.)

Deng said that he believes artists should have more agency in the creation and use of generative AI tools like DALL-E, but isn’t sure, exactly, what form that might take.

“[A]rtists need to be a part of [the] ecosystem as much as possible,” Deng said. “I believe that if we can find a way to make the flywheel of creating art faster, we’ll really help the industry out a bit more … In a sense, every artist has been inspired by artists who’ve come before them, and I wonder how much of that will be accelerated by this.”

Facebook is testing a new feature that invites some users—mainly in the US and Canada—to let Meta AI access parts of their phone’s camera roll. This opt-in “cloud processing” option uploads recent photos and videos to Meta’s servers so the AI can offer personalized suggestions, such as creating collages, highlight reels, or themed memories like birthdays and graduations. It can also generate AI-based edits or restyles of those images. Meta says this is optional and assures users that the uploaded media won’t be used for advertising. However, to enable this, people must agree to let Meta analyze faces, objects, and metadata like time and location. Currently, the company claims these photos won’t be used to train its AI models—but they haven’t completely ruled that out for the future. Typically, only the last 30 days of photos get uploaded, though special or older images might stay on Meta’s servers longer for specific features. Users have the option to disable the feature anytime, which prompts Meta to delete the stored media after 30 days. Privacy experts are concerned that this expands Meta’s reach into private, unpublished images and could eventually feed future AI training. Unlike Google Photos, which explicitly states that user photos won’t train its AI, Meta hasn’t made that commitment yet. For now, this is still a test run for a limited group of people, but it highlights the tension between AI-powered personalization and the need to protect personal data.

This growth can be attributed to Meesho’s leadership position as the most downloaded shopping app in India in both 2022 and 2023, increased transaction frequency among existing customers, and a diversified category mix. Additionally, Meesho’s focus on improving monetization through value-added seller services contributed to its revenue growth. Meesho also disclosed its audited performance for the first half of FY 2023-24, reporting consolidated revenues from operations of Rs 3,521 crore, marking a 37% year-over-year increase. The company achieved profitability in Q2 FY24, with a significant reduction in losses compared to the previous year. You might’ve heard of Grok, X’s answer to OpenAI’s ChatGPT. It’s a chatbot, and, in that sense, behaves as as you’d expect — answering questions about current events, pop culture and so on. But unlike other chatbots, Grok has “a bit of wit,” as X owner Elon Musk puts it, and “a rebellious streak.” Long story short, Grok is willing to speak to topics that are usually off limits to other chatbots, like polarizing political theories and conspiracies. And it’ll use less-than-polite language while doing so — for example, responding to the question “When is it appropriate to listen to Christmas music?” with “Whenever the hell you want.” But Grok’s ostensible biggest selling point is its ability to access real-time X data — an ability no other chatbots have, thanks to X’s decision to gatekeep that data. Ask it “What’s happening in AI today?” and Grok will piece together a response from very recent headlines, while ChatGPT, by contrast, will provide only vague answers that reflect the limits of its training data (and filters on its web access).
