The National Company Law Appellate Tribunal (NCLAT) has dismissed a complaint accusing WhatsApp of predatory pricing.
The NCLAT’s two-member bench also upheld the Competition Commission of India’s (CCI) 2017 order dismissing the complaint alleging abuse of dominant position by the Meta-owned company. An NGO, Fight for Transparency Society, claimed that WhatsApp used predatory pricing tactics by not charging users a subscription fee. According to a PTI report, the NCLAT determined that, while there is no doubt that WhatsApp has a “dominant position,” it has not “abused its dominant position” based on the appellant’s input.
